Terms of Service

OC Tick Pty Ltd (“OC Tick”, “we”, “us”, “our”) provides a digital platform and associated services
for the management of building documentation, compliance records, and Approved Building
Manuals.
By accessing or using our services, you agree to be bound by these Terms of Service.
1. Definitions
- Platform means the OC Tick digital system used to manage Building Manuals and related records.
- Services means the Platform and any related services provided by OC Tick.
- Customer means the Owners Corporation, entity, or individual subscribing to the Services.
- Users means individuals authorised by the Customer to access the Platform (including Strata Managers, committee members, and other authorised parties).
- Building Manual means the structured collection of building records maintained within the Platform.
2. Services Provided
OC Tick provides:
- • A digital platform for storing and managing Building Manuals
- • Tools for uploading, organising, and accessing building documentation
- • Compliance tracking and notification functionality
- • Support services related to building documentation and record management
OC Tick may also provide advisory, certification, or compliance-related services where separately agreed.
3. Nature of Services
OC Tick provides infrastructure and support for managing building
documentation.
We do not:
- • Replace Strata Managers
- • Act as the Owners Corporation
- • Provide legal advice unless explicitly engaged to do so
Customers remain responsible for:
- • Compliance with applicable laws and regulations
- • Accuracy of documents uploaded
- • Decisions relating to building management and compliance
4. User Accounts and Access
The Customer is responsible for:
- • Authorising Users
- • Managing access permissions
- • Ensuring login credentials are kept secure
Users must not:
- • Share login credentials
- • Access data without authorisation
- • Use the Platform for unlawful purposes
OC Tick may suspend access where misuse is suspected.
5. Data Ownership
All data, documents, and records within the Platform remain the
property of the Customer (Owners Corporation).
OC Tick does not claim ownership of
Customer data.
OC Tick may use aggregated, de-identified data for service improvement.
6. Data Responsibility
The Customer is responsible for ensuring that:
- • All uploaded documents are accurate and authorised
- • Personal information is collected and provided in accordance with privacy laws
- • Appropriate consents have been obtained where required
OC Tick is not responsible for errors, omissions, or inaccuracies in uploaded content.
7. Availability of Services
OC Tick will use reasonable efforts to ensure the Platform is
available and functioning.
However:
- • Continuous, uninterrupted access is not guaranteed
- • Maintenance, updates, or external factors may affect availability
We may modify or update the Platform at any time.
8. Fees and Payment
Fees are set out in the applicable proposal, agreement, or
pricing schedule.
Unless otherwise agreed:
- • Fees are payable in advance
- • Subscriptions may be for fixed terms (e.g. 12, 24, or 36 months)
- • Fees are non-refundable except as required by law
Failure to pay may result in suspension of access.
9. Term and Termination
Term
The agreement continues for the agreed subscription period.
Termination by Customer
Customers may terminate in accordance with their agreement terms.
Termination by OC Tick
We may suspend or terminate access if:
- • These Terms are breached
- • Fees remain unpaid
- • The Platform is misused
10. Data Access on Termination
Upon termination:
- • Customers may request access to their data within a reasonable period
- • OC Tick may retain archived data for legal and compliance purposes
11. Intellectual Property
All intellectual property in the Platform remains the property of OC
Tick.
Customers are granted a limited, non-exclusive licence to use the Platform for its
intended purpose.
12. Limitation of Liability
To the maximum extent permitted by law:
- • OC Tick is not liable for indirect, incidental, or consequential loss
- • OC Tick is not responsible for third-party services or documents
- • OC Tick’s total liability is limited to the fees paid for the Services
Nothing in these Terms excludes rights that cannot be excluded under Australian law.
13. Compliance and Regulatory Use
The Platform is designed to support compliance processes.
However:
- • It does not guarantee regulatory approval
- • It does not replace professional advice
- • Customers must ensure compliance obligations are met independently
14. Security
OC Tick takes reasonable steps to protect data, including:
- • Secure cloud infrastructure
- • Access controls
- • Monitoring and security practices
Customers are responsible for managing user access and credentials.
15. Changes to Services or Terms
OC Tick may update:
- • The Platform
- • These Terms
Updates will be published, and continued use constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of Victoria, Australia.
